the environmental impacts of whaling and the ancillary activities of the whaling fleet, such as
refuelling at sea and offal discharge, on the highly sensitive Antarctic marine environment.

This could impose additional safeguards for the Antarctic environment in relation to JARPA II in
line with improvements achieved in relation to ship-borne tourism operations, which raise many

Over time, sustained pressure through the ATS is likely to increase further the difficulties faced by
Japan in operating its whaling fleet in the Southern Ocean, and ultimately contribute to the
complete cessation of Japanese special permit whaling in Antarctica.

Specifically, the Canberra Panel recommends that a party to the ATS, such as Australia or New
Zealand, seek to place the associated environmental risks and impacts of JARPA II on the agenda of
the Antarctic Treaty Consultative Meeting (ATCM) and its Committee for Environmental Protection
(CEP) in much the same way that Antarctic tourism has been considered as an issue of maritim
safety and environmental protection.

The Panel recommends initial steps for achieving this including that ATS parties:
1. immediately, during the current JARPA II whaling season, formally notifying the Government of
Japan in accordance with Article 13 (3) about concerns over their failure to comply with the
Environmental Protocol with respect to JARPA II and JARPA II related activities and, following
this step,
2. note this action in their annual report to other Treaty parties on steps taken to implement the
Environmental Protocol (the ‘Article 17 (1)’ report).

The next ATCM meeting will take place in Baltimore, United States, in April 2009.
