このワシントンタイムズの記事で、今回の秘密協定とこれまでの報道が繋がりました。
昨年9月の段階で、この「存在しない拘留者」の扱いに関する問題は挙がっていたんですね。存在しない拘留者に対して国際赤十字に報告する事項はない。よって、どう取り扱うかについても、ジュネーブ条約を考慮する必要がない─たしかに、そう現場で捉えられた可能性はありますね。しかし国際赤十字に報告しないこと自体がジュネーブ条約違反となる。しかし、仮にジュネーブ条約に違反しているとして、誰がどうやってアメリカに制裁を下せるというのか・・・。この条約には罰則規定がないですからね（そのためのＩＣＣ規程ですからね）。
それにしても、随分短い記事ですね・・・。

'Ghost' detainee investigation urged
New York, NY, Sep. 10 (UPI) -- Human Rights Watch Friday called for an independent investigation into allegations dozens of Iraqi detainees have been hidden from the Red Cross.
U.S. Army investigators told Congress Thursday detainees at Baghdad's Abu Ghraib prison -- ranging from two dozen to as many as 100 -- were hidden from the International Committee of the Red Cross at the request of the CIA.
The CIA's inspector general is investigating reports agency officers hid the prisoners from the Red Cross, which on the face of it is a violation of the Geneva Conventions.
"Secret detention is the gateway to torture," said Reed Brody, special counsel at the New York-based human rights group. "History shows that when people are taken off the books, they become vulnerable to mistreatment, torture and even 'disappearance.'"
