Until such a new order is established and until there is convincing proof
that Japan's warmaking power is destroyed, points in Japanese territory
to be designated by the Allies shall be 「occupied to secure the achievement」
of the basic objectives we are here setting forth.

The occupying forces of the Allies shall be withdrawn from Japan as soon as
these objectives have been accomplished and there has been established in
accordance with the freely expressed will of the Japanese people a peacefully
inclined and responsible government.

ポツダム宣言時には占領されていないのでSHALL。宣言受諾により「占領」は即実行。
占領は連合国の目的が達成するまで実施。占領が解除されたのはサンフランシスコ条
約。即ち、半島、台湾も含めてサンフランシスコ条約までは戦時国際法に基づく占領
地。


The terms of the Cairo Declaration 「shall be carried out」 and Japanese
sovereignty 「shall be limited」 to the islands of Honshu, Hokkaido, Kyushu,
Shikoku and 「such minor islands as we determine」.

　 カイロ宣言は（将来において）履行される。（将来において）連合国が決定する島々
と本州等に日本の主権は制限される。ポツダム宣言受諾時には「連合国決定する島々」
は未定。
決定したのはサンフランシスコ条約。決定に基づき権原者の日本のTITLE放棄が履行さ
れたのもサンフランシスコ条約。それまでは「占領地」。占領地がどのように統治さ
れるかは、連合国の意志次第。特別法（日本と連合国による条約）が存在しない限り、
一般法である戦時国際法が適用。
