12. WHALE SANCTUARY IN THE SOUTHERN
OCEAN

12.1 Report of Intersessional Working Group

The Report of the intersessional Working Group on a
Sanctuary in the Southern Ocean held on Norfolk Island,
South Pacific, in February 1991 was presented to the
Technical Committee by the Chairman of the Working
Group, Dr C.-G. Ducret (Switzerland). The Working
Group recommended by consensus to the Commission the
15 recommendations shown in Appendix 8:
(i) Recommendations 1, 10 and 13 relate to the Antarctic
Treaty system and other intergovernmental
arrangements;
(ii) Recommendations 3 and 7 were directed to the
Scientific Committee:
(iii) Recommendations 5, 6 and 14 proposed specific
actions by the IWC;
(iv) Recommendations 2, 8 and 12 related to legal
questions;
(v) Recommendations 1, 9, 11 and 15 concerned the
establishment of a sanctuary itself.

The Working Group proposed that the Commission should
take note of its Report and further endorse the 15
recommendations, which was agreed by the Technical
Committee and accepted by the Commission.
Japan asked the Chairman of the Scientific Committee if
the Committee studied the specifìc questions raised at the
Working Group. The Chairman of the Scientifìc
Committee responded that there was no substantial
discussion on the matter but there was little to gain in the
context of the conservation performance of the RMP by
modifying the procedure to take further account of
environmental change. Also, the Scientific Committee
believes that the RMP adequately considers the question of
under-reporting of catches.

12．南大洋鯨類保護区
12．1 　 国際作業グループ報告
1994年２月、南太平洋ノフォーク島で開かれた南大洋鯨類保護区
に関する国際作業グループの報告が作業グループ議長、C．-G．
デュクレ博士（スイス）によって技術委員会に対してなされた。
作業グループは全会合意により、国際捕鯨委員会に対して
15の推奨／勧告を行った。これは附属書８に記載されている。

（i）勧告／推奨１，10および13は南極条約機構とその他の
政府間諸合意に関するものである。
（ii）勧告／推奨３および７は科学委員会に対するものである。
（iii）勧告／推奨5，6および14はIWCによる特定の行動を提案
している。
（iv）勧告／推奨２，８および12は法的問題に関するものである。
（v）勧告／推奨４，９，11および15は保護区の設立そのもの
に関するものである。

作業グループは国際捕鯨委員会がこの報告書に留意し、技術委員会
で合意され、国際捕鯨委員会で受け入れられた15の勧告／推奨に
裏付けを与えるよう提言した。

日本は科学委員会議長に対して、作業グループで提起された
個別の案件に関して検討を行ったかどうか質問した。
科学委員会議長は、実質的な議論は無かったが、環境変化を
さらに計算に入れる手続きの変更による改訂管理方式（RMP）の
保全性能について、若干得るところがあったと答えた。
科学委員会はまた、RMPが捕獲の過少報告という問題を適切に
考慮に入れていると信ずるとした。

における漁期外、海域外捕鯨を含む莫大な違法、脱法捕鯨がまず
第一に頭に浮かぶのでしょう。ソ連崩壊後、少しずつその実態が明らかに
なってくるというのが1990年代のトピックスです。それ以前の
南米IWC非加盟諸国における日系現地法人の枠外捕鯨、海賊捕鯨も
捕鯨統計の不備すなわち資源保全上の欠陥領域として懸案になり続けて
います。）
