Background
背景
Since 2006, IFAW has convened several international panels of independent legal experts to review
the legality or otherwise of Japanese ‘scientific’ whaling (ie whaling carried out under the special
permit provisions of the International Convention for the Regulation of Whaling).
2006年以来、国際動物福祉基金（IFAW）は独立の法専門家による審議会（パネル）を、
日本の「科学的」捕鯨が合法性を有しているか否かについて検討するために何回か招集
してきた。
In November 2008 IFAW supported the convening of another such independent panel in Canberra.
The ‘Canberra Panel’ was chaired by Professor Donald Rothwell (Australian National University)
and involved some of Australia and New Zealand’s leading international lawyers and academics
with expertise in Antarctic law and policy.
2008年11月にIFAW はキャンベラで別のこのような独立審議会を招集することを
支持した。
「キャンベラ・パネル」はドナルド・ロスウェル教授（オーストラリア国立大学）
を議長とし、オーストラリアとニュージーランドの主導的な国際法学者と南極法、
政策に専門知識を有する学者を集めた。
It met to:
・consider potential breaches of the Antarctic Treaty System (ATS) by Japan’s whaling program
in the Southern Ocean, and
・identify possible responses under relevant conventions and Antarctic fora by overnments
opposed to these whaling activities.
パネルの目的は：
・南大洋における日本の捕鯨プログラムによる南極法体系の潜在的違反を考慮すること、
および
・これらの捕鯨行動にさらされた諸政府による関連条約および国際会議での可能な
応答の確認、であった。
The Canberra Panel Report endorses previous legal opinions that the Australian government can
take Japan to the International Court of Justice or the International Tribunal for the Law of the Sea
to challenge the legitimacy of Japan’s ‘scientific’ whaling program.
キャンベラ・パネル報告は以前の法的見解を裏付けるものだった。すなわちオースト
ラリア政府は日本に対して国際司法裁判所か国連海洋法裁判所へ提訴し、日本の
「科学的」捕鯨の正統性について争うことができるというものである。
The Panel’s full report was delivered to the Australian and New Zealand Governments in January
2009, a summary of the report follows.
パネル報告の全文はオーストラリアおよびニュージーランド政府に2009年１月に
