対イラク武力行使

国際法は各国が取り結んだ様々な条約と長年に渉り国際的に了承されてきた慣習法に基づいて成立するものだと言う認識に異論を唱える人はいないと思われる。アメリカを主体とした連合国は第二次世界大戦の勝者として、ニュルンベルグ裁判、東京裁判で国際法に基づいて戦争犯罪人を裁いてきた。これらの判例は国際法として遵守されるべきものだと考えられる。

去年の六月にイラクへの派遣命令を拒否したエーレン・ワタダ中尉がイラク戦争は国際条約や国際的な慣習に反しておりこの戦争に参加すれば自分自身も戦争犯罪を起こす事になると主張しました。
The war in Iraq violates our democratic system of checks and balances. It usurps international treaties and conventions that by virtue of the Constitution become American law. The wholesale slaughter and mistreatment of the Iraqi people with only limited accountability is not only a terrible moral injustice, but a contradiction to the Army’s own Law of Land Warfare. My participation would make me party to war crimes.

さらに、ワタダ中尉はこの戦争は 侵略戦争を禁じたニュルンベルク憲章を犯しているとも主張しました。
"Mr. President, you have violated: Article I of the Constitution by deceiving Congress, Article 2 of the U.N. Charter, U.N. Gen. Assembly Res. 3314 and the Nuremburg Tribunal Charter barring wars of aggression, and many other international and domestic laws. As a commissioned officer of the U.S. Armed Forces my legal and moral obligation is to the Constitution -- not to those who would issue unlawful orders. It is my duty to refuse to fight this illegal war."

アメリカと言う国は自分で法を作りそれで他者を裁くが、その法はアメリカには適用されないらしい。アメリカの作った国際法を尊重して命令拒否を行わざるを得なかったワタダ中尉は現在、軍法会議の判決が下るのを待つ身である。
