引き渡し求めない可能性も＝ジェンキンス氏の健康状態に「同情」−米駐日大使

　 ベーカー駐日米大使は１５日、都内の米大使館で一部記者団に対し、北朝鮮による拉致被害者、曽我ひとみさんの夫ジェンキンス氏の来日時に米政府が身柄引き渡しを求めない可能性もあるとの見方を示した。また、同氏の健康状態と家族をめぐる状況に同情していると述べた。 　 （時事通信）

ジェンキンス氏が相当する法は、アメリカ陸軍法85条” DESERTION”、ではないかと思う。

読んでみると、よく分からないところもあるが、確かに軍人と言うのはつらい仕事だと思う。

強力な敵を目前にして、腰が引いて敵前逃亡をしないのは、相当な精神力がいると、改めて思う(ライターさんも、相当の覚悟が必要だったと思う）。

だからアメリカがしぶとく恩赦を表明しないのも、アメリカ社会の秩序維持の点からよく理解できる。

しかしそれを認めさせかけているのも、日本の日本軍派兵、多国籍軍参加という地道な国際協力の積み上げがあったからだ。

ここからも、日本軍派兵の歴史的正しさが、証明されていることを見て取れる。

ART. 85. DESERTION



(a) Any member of the armed forces who --

(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;

(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or

(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States;

is guilty of desertion.

(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.

(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.http://usmilitary.about.com/library/milinfo/ucmj/blart-85.htm
