対イラク武力行使

列車事故と言っても、スペインの列車爆破テロ事件のことではない。今では世界中どこで電車に乗ってても、テロ爆破に遭って死ぬ可能性が出てきたので、少しは関係あるが。

私は英語が得意ではないので勉強の為にあれこれ記事を読んでいたら、例のオーストリアのザルツブルクの登山列車火災事件の判決に関する記事が目についた。

それも正直に言えば、次の一行がよく読めなかったのでしばらく考え込んだのが原因だが。

On Feb. 19, the Salzburg District Court ruled that a structural defect in the train's heater caused the blaze and cleared the defendants, including three officials of the train company, of professional negligence resulting in death and negligence in maintaining safety. The judge ruled that it was impossible for them to have foreseen the accident.

何度か読み直して、最後にやっとわかったのだが、どうも被告は全員無罪と言うことらしい。

いろいろ検索にかけて関連記事を読んでみた。ガーディアン・ヘラルド・BBCなど。

どうも日本のYOMIURIが、この問題に一番詳しく突っ込んだ記事を出してたみたいだ。

それによれば、オーストリアなどのドイツ語圏の法体系と、日本の法体系は違うらしい。

Under Austrian criminal law, corporations are not subject to punishment. In the case of the train fire, all the defendants were indicted as private persons. と言うのがそうらしい。個人の権利を強く保護すると言うことらしい。またよく読むと、信じられないことに、オーストリアには企業を対象とする刑罰が無くて、これから作ると言うことらしい。

などの被害者家族の切実な声も、被害者を出したイギリス・アメリカなどの国の記事に書かれている。しかし日本以外は全体としては淡白な取り扱いのように思えた。ざっと検索をかけた範囲でのことである。

ともかく、国によって法体系が違い、正義が違うかというのは興味深いことである。
