仮に分担金の肩代わりは自由勝手という慣習法が国連・AUで成立しかかっていたとして、それはIWCに於いて重大な制約が加えられた。

Nations Charter, which stipulates, inter alia, that “No State may use or encourage the use of economic, political or any other type of measure to coerce another State in order to obtain from it the subordination of the exercise of its sovereign rights and to secure from it advantages of any kind.” New Zealand’s resolution was eventually adopted by consensus following some negotiation and re‐drafting. It concludes by endorsing “the complete independence of sovereign countries to decide their own policies and freely participate in the IWC (and other international forums) without undue interference or coercion from other sovereign countries.”
つまり「ODAによる他国の手篭め」＋「分担金の肩代わり」＋「派遣者の運賃・日当支払い」などという醜怪な金権主義は否定された。
従ってそれ以降分担金の肩代わりなどを実行する場合は、２００１年IWCでの「IWCに於いての透明性決議」を念頭に置き、成文の規範「国連憲章に基づく各国間の友誼・協力についての国際法の原則に関する宣言」に沿って公明正大に行うことが確認された。
若し慣習法と喚くならこれが慣習法だ。
それともその後も日本がこの決議に違反し続けている、その状況の方が慣習法だと言うなら、それも一理ある。（爆笑）
