The following reports on the recent defeat of the American Servicemembers' Protection Act (ASPA). This anti-ICC amendment, proposed by Senator Jessie Helms, passed the Senate by 78-21 on December 7th as part of the Department of Defense Appropriations bill for Fiscal Year 2002. This version of the ASPA was weaker than the one adopted by the House last May as part of the State Department Authorization bill.
An excerpt reads:
"The Helms amendment would have barred nearly all cooperation with the International Criminal Court, going so far as to authorize the president "to use all means necessary and appropriate to bring about the release of any person" detained by the court who is an official or member of the military from the United States or any of its allies...
Helms's amendment would have done gratuitous harm to US national interests.
And it exhibited extremely bad timing."
