The very existence of "ghost detainees" was first raised by the International Committee of the Red Cross which is vested under the Geneva Conventions with the responsibility to monitor the health and well being of prisoners, a function that begins with registering all of them.

The Geneva Conventions do make allowances for short periods during which detainees do not have to be registered, but only for military security reasons. After the hearing, Kern offered an example: A military may hold an insurgent leader for a few days if they are planning an operation against his organization, and to register him would be to let their adversary know the operation was coming.
