Japan worried about fair hearing in whaling case

The sole Japanese representative on the bench, Justice Hisashi Owada, took issue with the court's decision to confirm the intervention, according to a statement released by the court in The Hague on Thursday.
"Judge Owada notes that, although Japan does not raise a formal objection to the intervention, it seems evident that it is deeply concerned that New Zealand's intervention could have consequences that would affect the equality of the parties to the dispute, and thus the fair administration of justice," the statement said.
The court unanimously approved New Zealand's intervention and rejected Japan's claim, saying NZ was not a full "party" to the proceedings, but could only make limited observations.
Although Justice Owada voted in favour of New Zealand's intervention, he said he wished to place on record his "serious reservation" about the court's approach to the issue.
He also said it was regrettable that the anti-whaling countries appeared to be actively collaborating in their litigation strategy to promote their common interests.
