殺人未遂は当然その要件を満たすので、AD号船長はSM２船長に対しこの権利を行使しようと試みたと言う。

The charge of attempted murder qualifies and thus Captain Pete Bethune acted in accordance with New Zealand law in his attempt to serve the captain of the Shonan Maru No. 2 who deliberately sank his ship and almost killed his crew and himself.

このためSS船を発進したボートがSM２に追いすがったがSM２は捕まらないよう全速力で逃げ回ったと言う。
