Study: Israel to be viewed as occupier after Gaza pullout
Even after withdrawing from the Gaza Strip under Prime Minister Ariel Sharon's unilateral disengagement plan, Israel will still be considered under international law as an occupying power and be held ultimately responsible for the crowded territory, according to a study released Sunday.
The disengagement plan hold that Israel will maintain control over the crossings into Gaza Strip, its coastline and airspace.
In such a scenario, international law will still hold Israel responsible for the territories and its population, according to the study by legal experts from the Justice Ministry, Foreign Ministry and the Israel Defense Forces.
National Security Council head Giora Eiland told the Knesset Foreign Affairs and Defense Committee last week that Israel will stay deployed on the Philadelphi route after withdrawing from the Gaza Strip out of concern it will turn into 'another south Lebanon.'
"We must be aware that the disengagement does not necessarily exempt Israel from responsibility in the evacuated territories," said the 47-page report.
Officials in the National Security Council and tthe Foreign Ministry blame the IDF for the predicament, saying that it is the army which maintains that a presence along the Philadelphi route is crucial for security, Army Radio reported.
Israel could reduce its responsibility over the territory, where 8,200 Jewish settlers currently live among 1.3 million Palestinians, if someone else were to take control there, the report said.
"The more active control is given to other parties, the more difficult it will be to claim Israel is still responsible," the study said.
The study, which has been submitted to the National Security Council, responsible for implementing the withdrawal, said that the involvement of an international force in Gaza or the establishment of a Palestinian state would reduce the burden on Israel.
However, officials speaking on condition of anonymity, said that Sharon was unlikely to endorse either option.
"Israel faces a legal problem with its plan to encircle the Gaza Strip from all direction such as maintaining control of the Philadelphi route and so on," Construction and Housing and Immigrant Absorption Minister Tzipi Livni told Army Radio Sunday morning.
Livni, a lawyer by profession and a staunch supporter of Sharon's disengagement plan, noted that the legal issues impinge on the decree to which Israel can claim that its occupation of the Gaza Strip ends with pulling out both army and settlers.
Yet the disengagement plan should be implemented despite the ensuing legal problems, and Israel must weigh the humanitarian and strategic developments in Gaza following the pullout and act accordingly, Livni said.
The report also examined the possible drawbacks for Israel if the Palestinians were to declare a state or an international force was brought in.
"A Palestinian state would be free to conduct its foreign relations and we can expect a flood of agreements with Arab nations and Muslim organizations," the report said, warning of Palestinian military pacts with Israel's enemies.
The report also warned that international involvement in Gaza could set a precedent for the West Bank where Sharon hopes to hold large swaths in any future peace deal.
